Kandy E. Messenger is a litigator whose practice concentrates on consumer financial services litigation and compliance and complex litigation with an emphasis in the areas of commercial litigation, personal injury, employment law and professional liability.  She has successfully tried cases to final verdict in both state and federal courts; is licensed to practice law in Texas, 2006; and is also licensed in the US District Courts for the Southern, Northern, Eastern and Western District of Texas, District of Colorado and United States Court of Appeals for the Fifth Circuit.
 
LITIGATION & COMPLIANCE. As a litigator, she has spent several years defending those in the consumer financial services industry, including debt collectors, billing companies, lenders, corporations, insurance companies, and other entities.  She has successfully defended individual and class action cases involving allegations of consumer fraud, unfair business practices, false advertising, breach of contract, and violations of federal, state and local regulatory statutes, including Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), Texas Debt Collection Practices Act (TDCPA), Texas Deceptive Trade Practices Act (DTPA), Consumer Financial Protection Bureau (CFPB) rules and regulations, Electronic Fund Transfer Act (EFTA), and Telephone Consumer Protection Act (TCPA).  With this unique insight, she regularly provides practical, strategic and tactical advice to clients outside the courtroom by assisting them with an array of compliance matters, including auditing, developing and executing policies and procedures to ensure sound business practices and to address regulatory changes, consumer demands, and industry standards; to respond to regulatory investigations and subpoenas, and to avoid future compliance issues.
